Binding norms to end impunity of TNCs

Following its establishment three years ago, the record of the Working Group on the issue of human rights and transnational corporations (TNCs) and other business enterprises is unsatisfactory. And with good reason. Leaving aside the political will of its members, governments and TNCs, the Working Group’s mandate does not allow it to monitor the activities of TNCs that are harmful to human rights. In fact, its mandate is essentially to promote Mr John Ruggie’s Guiding Principles and to identify good practices on the part of TNCs. Despite numerous communications addressed to it concerning human rights violations committed by TNCs, this working group is unable to respond to the grievances of victims, as it itself acknowledges in its first report
